Terms of Service

Overview

These Terms of Service govern the web design services provided by TherapyBuilt, operated by Albuquerque’s Finest Web Design (AFWD). By engaging TherapyBuilt for a project, you agree to these terms. If you have questions before engaging our services, please email hello@therapybuilt.com.

Scope of work

The specific deliverables, timeline, and pricing for each project are agreed upon before work begins, either in writing via email or in a separate project agreement. These Terms apply in addition to any project-specific agreement. If there is a conflict, the project-specific agreement governs.

Payment

TherapyBuilt charges a flat project fee agreed upon before work begins. A deposit of 50% is due before any design work starts. The remaining balance is due before the site is transferred to your hosting or made public. All fees are in US dollars. We do not charge ongoing fees for sites we build — you own your site outright.

Revisions

Each project includes two rounds of revisions as described in the project scope. A revision round means a consolidated set of feedback addressed in one pass. Requests that significantly expand the original scope — such as adding new pages, features, or sections not included in the original agreement — may be quoted and billed separately.

Ownership and licensing

Upon receipt of final payment, you own the completed website design and all custom code created for your project. TherapyBuilt retains the right to display the project in our portfolio unless you request otherwise in writing. Third-party assets (fonts, stock images, plugins) remain subject to their own licenses, which we will document for you at handoff.

Client responsibilities

You are responsible for providing accurate content (text, images, credentials) for your site and for reviewing and approving the staging site before launch. Delays caused by late content delivery or extended review periods may affect the project timeline. TherapyBuilt is not responsible for errors in content you provide.

Hosting and maintenance

TherapyBuilt builds sites for deployment on your own hosting account. Optional ongoing maintenance and hosting packages are available — details are provided upon request. After the post-launch support period specified in your project scope, any ongoing updates and maintenance not covered by a separate package are your responsibility.

Confidentiality

TherapyBuilt will keep any confidential business information you share during the project private and will not share it with third parties. This does not apply to information that is publicly available or that we are required to disclose by law.

Disclaimer of warranties

TherapyBuilt provides services “as is.” We do not guarantee that your website will achieve specific business outcomes, rankings, or client acquisition results. Web design is one factor among many in practice growth.

Limitation of liability

TherapyBuilt’s liability for any claim arising from our services is limited to the amount you paid for the project in question. We are not liable for indirect, incidental, or consequential damages.

Governing law

These Terms are governed by the laws of the State of New Mexico, United States.

Changes to these terms

We may update these Terms from time to time. The “last updated” date reflects the most recent version. Engagements entered into before a change are governed by the Terms in effect at the time of engagement.
